VOLUNTEER AND REIMBURSEMENT PROGRAM TERMS

Expensify.org (“Expensify.org”) recognizes that volunteer activities related to certain charitable causes such as acts to address homes, hunger, reentry, youth and climate initiatives (such charitable initiatives referred to generally as the “Campaigns”) are vital to the individuals and causes that they serve. Accordingly, as part of Expensify.org’s Service, users may sign up with Expensify.org to complete certain volunteer activities of their choosing and request reimbursement or a stipend for such volunteer expenses and activities (collectively, “Reimbursements”) from Expensify.org and its Third-Party Service Providers, as applicable, subject to certain conditions and restrictions set forth by Expensify.org from time to time (such program, the “Volunteer Reimbursement Program” or “Program”). Please read carefully the following terms and conditions related to the Program (the “Volunteer and Reimbursement Terms”).  By participating in the Program, you acknowledge that you have read these Volunteer and Reimbursement Terms and agree to abide by the requirements explained herein. These Volunteer and Reimbursement Terms are incorporated into Expensify.org’s Terms of Service. These Volunteer and Reimbursement Terms govern your access to and use of the Program and constitute a binding legal agreement between you and Expensify.org. Any capitalized terms not defined herein shall have the meaning set forth in Expensify.org’s Terms of Service.

YOU ACKNOWLEDGE AND AGREE THAT, BY JOINING AN EXPENSIFY.ORG FUND POLICY, OR PARTICIPATING IN THE PROGRAM, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE VOLUNTEER AND REIMBURSEMENT TERMS. IF YOU DO NOT AGREE TO THESE VOLUNTEER AND REIMBURSEMENT TERMS, INCLUDING THE RELEASE, THEN YOU HAVE NO RIGHT TO PARTICIPATE IN THE PROGRAM.  

Expensify.org reserves the right, at its sole discretion, to modify, discontinue or terminate the Program or to modify these Volunteer and Reimbursement Terms, at any time and without prior notice. If we modify these Volunteer and Reimbursement Terms, we will post the modification on https://expensify.org/ (the “Site”) or provide you with notice of the modification. We will also update the “Last Updated Date” at the top of these Volunteer and Reimbursement Terms. By continuing to participate in the Program after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Volunteer and Reimbursement Terms. If the modified Volunteer and Reimbursement Terms are not acceptable to you, your only recourse is to cease participating in the Program. 

User Representations, Warranties, and Covenants

By accessing or participating in the Program you represent and warrant to Expensify.org that: (1) you are of legal age to form a binding contract, (2) all information you submit is accurate, current and complete; (3) you will maintain the accuracy and completeness of such information, (4) you have a valid bank account where any approved Reimbursement can be provided, (5) you will return any Reimbursement to Expensify.org that was issued based on inaccurate, false, or otherwise fraudulent information submitted to Expensify.org, and (6) you have read the Volunteer and Reimbursement Terms completely. You also certify that you are legally permitted, eligible and able to participate in the Program and take full responsibility for your participation in the Program. You also acknowledge and agree that: (1) you are volunteering without promise or expectation of compensation, and your relationship with Expensify.org shall not be that of an employee or contractor; (2) except for those expenses in compliance with the Program and its requirements for Reimbursement, you shall not be authorized to incur any expenses on behalf of Expensify.org and will be responsible for all expenses incurred while volunteering; (3) you will not seek a Reimbursement for any costs incurred or activities that are not in compliance with the Program or its requirements for Reimbursement; and (4) you shall consult your personal tax advisor for any questions about your personal tax situation with respect to any Reimbursements.  These Volunteer and Reimbursement Terms are void where prohibited by law, and the right to access the Program is revoked in such jurisdictions.

You also acknowledge and agree that it is your responsibility to be covered and able to carry out any activities and Expensify.org accepts no responsibility if for any reason you are not covered by your insurance in the event of any loss, illness, injury or otherwise. 

Release

YOU FURTHER AGREE THAT YOU, FOR YOURSELF, YOUR HEIRS, YOUR EXECUTORS, YOUR ADMINISTRATORS, YOUR TRUSTEES, AND ANY AND ALL SUCCESSORS IN INTEREST, FULLY AND FOREVER RELEASE AND WAIVE ANY AND ALL RIGHTS, CLAIMS, AND LIABILITIES THAT YOU MAY HAVE AGAINST EXPENSIFY.ORG OR ITS EMPLOYEES, OFFICERS, DIRECTORS, MEMBERS, AGENTS OR AFFILIATES FOR ANY INJURIES OR DAMAGES THAT RESULT FROM YOUR TRAVEL TO VOLUNTEER ACTIVITIES OR PARTICIPATION IN VOLUNTEER ACTIVITIES, TO THE FULLEST EXTENT PERMITTED BY LAW.

Sharing Your Story

As part of the Program, you may choose to share your volunteer story with us and the rest of the Expensify.org community by sending us narrative details about your work, photos/videos of those involved, and other information about your work.  By uploading any Content when you share your story, including photographs or videos or personal information such as your first name, last initial, city and state (collectively, the “Likeness”), related to a particular Reimbursement, or campaign promoted by or survey collected by us, you hereby irrevocably grant Expensify.org and its affiliates (collectively, the “Released Party”) all rights and permission to create, use, publish, modify, market, license, sell and distribute the Likeness that you provide to the Released Party. The Likeness may be used and/or published individually or in conjunction with other produced works, and in any medium (including without limitation, print publications, public broadcast, online format) and for any lawful purpose, including without limitation, trade, exhibition, illustration, promotion, publicity, marketing, advertising and electronic publication. Without limiting the foregoing, the Released Party intends to use Likeness in its general marketing materials and/or for other commercial purposes. It remains your responsibility to use your best judgment in choosing the information you will post when you share your story.  

You understand and agree that this Likeness will become the property of the Released Party and will not be returned. 

If you are featuring other individuals when you share your story, it is your reasonability to make sure all parties agree that you may share your story with us and the Expensify.org community. You hereby represent and warrant that you have obtained any authorization or consent for any individuals who are not you in the photography and/or video and that they too have released the Released Party’s use or inspection of the Likeness. You hereby waive any right that you may have to inspect or approve the Released Party’s use of the Likeness, or the advertising copy or printed matter that may be used in connection with the use and/or publication of the Likeness.  Please use this form to obtain consent if necessary. 

You further release the Released Party from any and all liability arising out of such use of said video or photography and shall have no proprietary interest in the Released Party by reason of this use. You acknowledge that the Released Party shall not be required to provide compensation to use any film, video, or photos that include the Likeness. You hereby hold harmless and release and forever discharge the Released Party from all claims, demands, and causes of action which you and your heirs, representatives, executors, administrators, or any other persons acting on your behalf or on behalf of your estate have or may have by reason of this authorization. 

If said photography or video is registered for copyright, you hereby assign said copyright and the right to renew said copyright to the Released Party, and if such photography or video has not been registered for copyright, you hereby assign the Released Party the right to copyright the same in its own name.

Campaigns

The Program is divided into Campaigns, and the process for the Reimbursement related to volunteer activities is outlined in each of the respective Campaign sections. Although many steps may seem similar, please be sure to read the requirements for each Campaign carefully. Above all, remember to include receipts or other documentation for the items to be Reimbursed, and note that Reimbursements may be delayed or denied in the event that you fail to follow all requisite steps. By submitting your receipt or any related materials or documentation, including your Likeness, you acknowledge and agree that Expensify.org may share your receipt, e-mail address and Likeness with donors to Expensify.org, Expensify.com and users of Expensify.com who participate in the Karma Program.  Time spent volunteering is not eligible for Reimbursement unless otherwise specified in the Campaign.
